Welcome to Catering Shop! The terms “we”, “us” and “our” refer to Catering Shop. We operate this store and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the “Services”). Catering Shop is powered by Shopify, which enables us to provide the Services.

These terms and the policies referenced here (the “Terms of Service” or “Terms”) describe your rights and responsibilities when using the Services. Please read them carefully: they contain important information about your legal rights, including disclaimers of warranties and limitations of liability.

By visiting, interacting with or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use or access the Services.

Section 1 — Access and account

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence and have given consent for your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including browsing or purchasing products, you may be asked for information such as your email address, billing, payment and shipping details. You represent and warrant that the information you provide is accurate, current and complete and that you have the rights necessary to provide it. You are solely responsible for maintaining the security of your account credentials and all account activity. You may not transfer, sell, assign or license your account to another person.

Section 2 — Our products

We make every effort to represent products and services accurately. Colors and appearance may vary depending on your device and its settings. We do not guarantee that the appearance or quality of products or services will meet your expectations or be identical to their depiction online. Product descriptions may change at any time without notice at our discretion. We may discontinue products or limit quantities offered to any person, geographic region or jurisdiction on a case-by-case basis.

Section 3 — Orders

When you place an order, you make an offer to purchase. Catering Shop may accept or decline an order at its discretion for any reason. An order is not accepted until we confirm acceptance; payment must be received and processed before acceptance. Review your order carefully before submitting it, because we may be unable to accommodate cancellation requests after acceptance. If we decline, change or cancel an order, we will attempt to notify you using the email, billing address and/or telephone number provided at checkout.

Purchases are eligible for return or exchange only under our Refund Policy. You represent and warrant that purchases are for personal or household use, not commercial resale or export.

Section 4 — Prices and billing

Prices, discounts and promotions may change without notice. The price charged is the price in effect when the order is placed, as stated in the order confirmation email. Unless otherwise stated, prices do not include taxes, shipping, handling, customs or import charges. Online prices may differ from prices in physical stores or other online stores operated by third parties. Promotions may have separate terms; where those terms conflict with these Terms, the promotion terms prevail.

You agree to provide current, complete and accurate purchase, payment and account information and promptly update information including your email address, card number and expiry date so that transactions can be completed and we can contact you as needed. You represent and warrant that (i) your card information is true, accurate and complete, (ii) you are authorized to use the card, (iii) the card issuer will honor the charges, and (iv) you will pay charges at the listed prices, including shipping, handling and applicable taxes.

Section 5 — Shipping and delivery

We are not liable for shipping or delivery delays. Delivery times are estimates, not guarantees. We are not responsible for delays caused by carriers, customs or events outside our control. Title and risk of loss pass to you when we transfer products to the carrier.

Section 6 — Intellectual property

The Services, including trademarks, brands, text, displays, images, graphics, product reviews, video, audio and their design, selection and arrangement, are owned by Catering Shop, its affiliates or licensors and protected by United States and foreign patent, copyright and other intellectual property laws.

These Terms permit personal, noncommercial use only. Without prior written consent, you must not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store or transmit material from the Services. Except as expressly provided, these Terms do not grant any license or other rights under the patents, trademarks, copyrights or other intellectual property of Catering Shop, Shopify or third parties. Unauthorized use may violate federal and state intellectual property laws. All rights not expressly granted are reserved.

The Catering Shop name, logo, product and service names, designs and slogans are trademarks of Catering Shop, its affiliates or licensors and may not be used without prior written permission. Shopify names, logos, product and service names, designs and slogans are Shopify trademarks. Other names, logos, product and service names, designs and slogans belong to their respective owners.

Section 7 — Optional tools

We may provide access to third-party tools that we neither monitor nor control or influence. You acknowledge that these tools are provided “as is” and “as available”, without warranties, representations, conditions or endorsement. We have no liability arising from or relating to your use of optional third-party tools. Use is entirely at your own risk and discretion; you should understand and agree to the relevant provider’s terms. New features, tools and resources offered through the Services in the future are also subject to these Terms.

Section 8 — Third-party links

The Services may include materials and hyperlinks supplied or operated by third parties, including embedded features. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites you choose to access. If you leave the Services to access them, you do so at your own risk.

We are not responsible for harm or damage related to accessing third-party websites or purchasing or using their products, services, resources or content. Review and understand third-party policies and practices before transacting. Direct complaints, claims, concerns and questions about third-party products or services to the third party.

Section 9 — Relationship with Shopify

Catering Shop is powered by Shopify, enabling us to provide the Services. Sales and purchases in this store, however, are made directly with Catering Shop. You acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Catering Shop, including injury, damage or loss arising from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Catering Shop.

Section 10 — Privacy policy

Personal information collected through the Services is subject to our Privacy Policy. Certain information may also be subject to Shopify’s Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Shopify hosts the Services and collects and processes information about your access and use to provide and improve the Services. Information submitted through the Services is transmitted to and shared with Shopify and third parties, which may be in countries other than your country of residence, to provide the Services. Section 11 — Feedback

If you submit, upload, post, email or otherwise transmit ideas, suggestions, feedback, reviews, proposals, plans or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display it in any medium for any purpose, including commercial use. We may use these rights to operate, provide, evaluate, enhance, improve and promote the Services and perform obligations or exercise rights under these Terms.

You represent and warrant that you own or have all necessary rights to the Feedback, have disclosed any compensation or incentive received in connection with its submission, and that it complies with these Terms. We are not required to keep Feedback confidential, pay compensation for it or respond to it.

We may, but are not obliged to, monitor, edit or remove Feedback that we determine in our discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, otherwise objectionable, or violates intellectual property rights or these Terms.

Your Feedback must not violate third-party rights, including copyright, trademark, privacy, personality or other personal or proprietary rights. It must not contain defamatory, unlawful, abusive, hateful or obscene material or viruses or malware that could affect the Services or related websites. You must not use a false email address, impersonate another person or mislead us or others about its origin. You are solely responsible for your Feedback and its accuracy. We assume no liability for Feedback posted by you or any third party.

Section 12 — Errors, inaccuracies and omissions

Information on or within the Services may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct them, change or update information and cancel orders when information is inaccurate, at any time without prior notice, including after an order is submitted.

Section 13 — Prohibited uses

You may access and use the Services only for lawful purposes. You must not, directly or indirectly: (a) use them for unlawful or malicious purposes; (b) violate international, federal, provincial or state regulations, rules, laws or local ordinances; (c) infringe our or others’ intellectual property rights; (d) harass, abuse, insult, harm, defame, slander, disparage, threaten or injure our employees or others; (e) submit false or misleading information; (f) send, knowingly receive, upload, download, use or reuse material that does not comply with these Terms; (g) transmit or procure advertising or promotional material, including junk mail, chain letters, spam or similar solicitations; (h) impersonate or attempt to impersonate another person or entity; or (i) engage in conduct that restricts or inhibits use or enjoyment of the Services or that, in our judgment, may harm or expose Catering Shop, Shopify or users to liability.

You also agree not to: (a) upload or transmit viruses or malicious code affecting the Services; (b) reproduce, duplicate, copy, scrape, sell, resell or exploit any portion of the Services; (c) track others’ personal information; (d) spam, phish, pharm, pretext, spider, crawl or scrape; (e) use robots, spiders, scraping or data-gathering tools, automated devices or processes, AI tools including agentic AI, or other automated or manual means to access the Services; or (f) interfere with or circumvent security or authorization features, robot exclusion headers or other access restrictions. We may suspend, disable or terminate an account without notice if we determine these Terms have been violated.

Section 14 — Agents

14.1 This section (“Agent Terms”) applies when you use, authorize, enable or deploy an Agent to access, use or interact with the Services. An “Agent” is software or a service capable of autonomous or semi-autonomous action on behalf of or at the direction of a person or entity, including actions without direct supervision or using that person’s or entity’s device.

14.2 Agents may not access, use or interact with the Services unless they always identify themselves and strictly comply with section 14.4. Agents must also refrain from access, use or interaction if we request it.

14.3 We may use measures, including technical means, to limit whether and how Agents access, use or interact with the Services.

14.4 Agents must: (i) identify each HTTP/HTTPS request as originating from an Agent and disclose their name by including “Agent/[Agent Name]” in the request’s user-agent string; (ii) not conceal or obscure that access, use or interaction originates from an Agent, including by imitating human behavior or interaction patterns or completing or bypassing CAPTCHAs or measures intended to distinguish computer use from human use; (iii) answer truthfully questions or prompts seeking to distinguish human from computer interaction; and (iv) not evade or bypass measures intended to block, limit, modify or control whether or how an Agent accesses, uses or interacts with the Services.

Section 15 — Termination

We may terminate this agreement or your access to all or part of the Services at any time without notice in our sole discretion. You remain liable for amounts due up to the termination date. Provisions regarding intellectual property, Feedback, termination, warranty disclaimers, limitations of liability, indemnification, severability, waiver and entire agreement, assignment, governing law, privacy, and other provisions that by their nature should survive, remain in effect after termination.

Section 16 — Disclaimer of warranties

Information provided on or through the Services is for general information only. We do not warrant its accuracy, completeness or usefulness. Reliance is at your own risk. We disclaim liability arising from reliance on it by you, other visitors or anyone informed of its content.

Except as expressly stated by Catering Shop, the Services and all products provided through them are supplied “as is” and “as available”, without any express or implied representation, warranty or condition, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement. We do not guarantee, represent or warrant uninterrupted, timely, secure or error-free use. Some jurisdictions limit or prohibit disclaimers of implied or other warranties; these disclaimers may therefore not apply to you.

Section 17 — Limitation of liability

To the maximum extent permitted by law, Catering Shop, its partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors, and Shopify and its affiliates, shall not be liable for injury, loss, claims or direct, indirect, incidental, punitive, special or consequential damages, including lost profits, revenue, savings or data, replacement costs or similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Services or products obtained through them. This includes claims related in any way to use of the Services or products, errors or omissions in content, or loss or damage arising from use of the Services or content or products posted, transmitted or otherwise made available through them, even if advised of the possibility.

Section 18 — Indemnification

You agree to indemnify, defend and hold harmless Catering Shop, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers against losses, damages, liabilities and third-party claims, including reasonable attorneys’ fees, arising from or relating to (1) your breach of these Terms or incorporated documents, (2) violation of law or third-party rights, or (3) access to or use of the Services.

We will notify you of indemnifiable claims, but failure to notify promptly does not relieve your obligations unless you are materially prejudiced. We may control their defense and settlement at your expense, including selecting counsel, but will not settle a claim requiring a nonmonetary obligation from you without your consent, which shall not be unreasonably withheld. You will cooperate in the defense, including providing relevant documents.

Section 19 — Severability

If a provision is held unlawful, void or unenforceable, it remains enforceable to the fullest extent permitted by applicable law. The unenforceable portion is deemed severed, without affecting the validity or enforceability of the remaining provisions.

Section 20 — Waiver; entire agreement

Failure to exercise or enforce any right or provision is not a waiver. These Terms and any policies or operating rules posted on this site or concerning the Services constitute the entire agreement and understanding between you and us, govern your use, and supersede prior or contemporaneous oral or written agreements, communications and proposals, including earlier versions of the Terms. Ambiguities shall not be construed against the drafting party.

Section 21 — Assignment

You may not delegate, transfer or assign this agreement or your rights or obligations without our prior written consent; any attempt is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice to you.

Section 22 — Governing law

These Terms and separate agreements under which we provide Services are governed by and construed in accordance with the federal, state or territorial courts in the jurisdiction where Catering Shop is headquartered. You and Catering Shop consent to the venue and personal jurisdiction of those courts.

Headings are for convenience only and do not limit or otherwise affect these Terms.

Section 24 — Changes to the Terms

You may review the latest Terms on this page at any time. We may, in our discretion, update, change or replace any part by posting changes on our website. You are responsible for checking for changes. We will notify you of material changes as required by applicable law; they take effect on the date stated in the notice. Continued access or use after changes are posted constitutes acceptance.
